Terms of Use

1. Acceptance

By using XFLOQ, you agree to these Terms of Use and the XFLOQ Privacy Policy. If you do not agree, do not use the service.

2. Driving responsibility

XFLOQ is an informational driving-awareness and navigation tool. It is not a substitute for attentive driving, road signs, traffic controls, emergency instructions, or applicable law. Do not interact with XFLOQ while driving. Use voice guidance or have a passenger operate the app when possible. You remain responsible for safe and lawful vehicle operation at all times.

3. Information may be incomplete

Navigation routes, speed limits, traffic conditions, camera records, public-source information, Community Road Reports, and other road information may be inaccurate, incomplete, delayed, stale, or unavailable. Never rely on XFLOQ as the sole source for a safety-critical decision.

4. Camera awareness

Camera-awareness features are provided for transparency and road awareness. XFLOQ does not authorize, encourage, or excuse speeding, evasion of lawful enforcement, interference with public infrastructure, or violation of law. Always obey posted limits and lawful instructions.

5. Community Road Reports

Community Road Reports allow users to submit fixed categories of temporary road information such as speed traps, crashes, debris, traffic, stalled vehicles, construction, flooding, or road closures. There is no public free-form text, profile, comment, or chat system.

When submitting or verifying a report, you agree to act in good faith and only report conditions you reasonably believe are present. You may not intentionally submit false reports, spam, attempt to manipulate confirmations/dismissals, automate abusive requests, harass others, interfere with the service, or use the feature for unlawful conduct.

XFLOQ may consolidate, expire, suppress, or remove reports and may restrict or block access associated with abusive behavior. Active reports normally expire one hour after the latest “Still There” confirmation, unless removed sooner. Users can mark reports as “Not There” and can report repeated abuse to support@xfloq.com.

6. Safety Recording and messaging

Safety Recording and trusted-contact messaging are user-initiated tools. You are responsible for complying with applicable recording, consent, privacy, and communications laws. XFLOQ does not represent that recording or messaging is legal in every circumstance or jurisdiction and does not provide legal advice.

7. No emergency service

XFLOQ is not an emergency communications service, emergency dispatch service, or life-saving system. If you need emergency assistance, contact the appropriate emergency service directly.

8. Third-party services and content

XFLOQ may use or display data from third-party mapping, routing, geocoding, road, camera, infrastructure, and platform providers. Third-party services are governed by their own terms and may change, fail, or become unavailable. Third-party names and trademarks belong to their respective owners.

9. Local data and privacy

XFLOQ’s data practices are described in the Privacy Policy. Community Road Reports are a deliberate network feature; most user-specific driving records are designed to remain local to the device unless you explicitly send or share them.

10. Availability and changes

Features may be modified, suspended, improved, or discontinued. XFLOQ may perform maintenance or make changes necessary for security, privacy, reliability, legal compliance, or third-party service changes.

11. Disclaimer of warranties

To the maximum extent permitted by applicable law, XFLOQ is provided “as is” and “as available,” without guarantees that road data, location, navigation, alerts, community reports, or other information will be complete, accurate, uninterrupted, or error-free.

12. Limitation of liability

To the maximum extent permitted by applicable law, XFLOQ and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the service. Nothing in these terms limits rights or liabilities that cannot legally be limited.

13. Changes to these terms

These terms may be updated as XFLOQ changes. The effective date above will be revised when a material update is published. Continued use after an update means the updated terms govern future use.
